Council Meeting 3rd March 1898

Thursday, March 3rd, 1898

Forty-first meeting of the Parish Council held in the School Room on Thursday, March 3rd, 1898.

Present: Mr S. Johnson (Chairman), Messrs J. Johnson, H. A. Spanton, J. Wood, and I. Shimwell (Clerk).

The minutes of the last meeting were read and confirmed.

The Clerk submitted an order of the Local Government Board authorising them to hold the Annual Assembly of the Parish Meeting on the same day as the Parish Meeting for the election of Parish Councillors, when it was unanimously decided that the Annual Assembly of the Parish Meeting be held on the same day and immediately after the meeting for the election of Parish Councillors.

The Clerk laid the following letter before the meeting, which he had received from Mr Muir Wilson, their solicitor.

Sheffield, 25 Jan. 1898

Dear Sir,

Parish Council v. Wright

I have very carefully considered what took place between us on Saturday last.

I strongly advise the Council to allow me to approach Messrs Taylor, the solicitors for Mr Wright, and obtain an agreement of reference of this important question to His Honor Judge Smyly as arbitrator.

I consider that the Council have a good case whether the subject is considered from the point of the quarry being the property of the inhabitants of the Parish or from that of it being the property of Mr Wright.

I think that if the Judge came to the conclusion that the property was Mr Wright’s (which I don’t think he will do), there is ample evidence to show that the inhabitants have by use of thirty years obtained a prescriptive right to take stones from this quarry.

Please let me hear from you so that I may communicate further with Messrs Taylor.

After the foregoing letter had been read, the Clerk was directed to inform Mr Wilson to proceed in the matter as he suggested.

A cheque for £7 16s 6d was drawn upon the Treasurer in favour of Mrs Green for the Dole Meal.
